SECTION 1305 – RULES,

DEFINITIONS, OF THE ARDEN

HILLS CITY CODE

THE CITY COUNCIL OF THE CITY

OF ARDEN HILLS, MINNESOTA,

ORDAINS:

SECTION 1. Chapter 13 – Zoning

Code, Section 1305 – Rules,

Scope, Interpretation, & Definitions,

subsection 1305.04 Definitions, is

hereby amended as follows:

- Floor area. Means the sum of

the horizontal area of all floors of a

building measured from the exterior

faces of the exterior walls, or from

the centerline of walls separating two

buildings, Excluding: decks, garages,

covered porches conforming with

Section 1325.03 Subd 2.D; attics,

crawl spaces and basements that do

not meet the minimum ceiling height

per Minnesota State Building Code

requirements.

SECTION 2. This Ordinance

shall become effective immediately

upon its passage and publication

according to law.

CITY OF FALCON HEIGHTS

RAMSEY COUNTY,

AN ORDINANCE AMENDING

CHAPTER 113 OF THE FALCON

HEIGHTS CITY CODE, THE

ZONING ORDINANCE, REZONING

PROPERTY TO PLANNED UNIT

DEVELOPMENT

THE CITY COUNCIL OF FALCON

HEIGHTS ORDAINS:

SECTION 1. Chapter 113 of

the Falcon Heights City Code is

amended to rezone to Planned Unit

Development the following legally

described property located within the

City of Falcon Heights, Minnesota:

The South 215.125 feet of Lot 1,

Block 1, Lindig Addition, Ramsey

County Minnesota (“Property”)

SECTION 2. Zoning Regulations.

The R-4, Medium Density Multiplefamily

Residential District regulations

shall apply to the Property subject to

the following modifications:

• The only permitted use is one

residential building with three

dwelling units.

• No conditional uses.

• The building may not exceed two

stories or 32 feet in height.

• Site plan, survey, parking, and

landscape plan prepared by Lot

Surveys Company Inc. dated June

11, 2009 on file with the City Clerk.

• Setbacks as depicted on the Site

Plan.

• Design Development plan

and elevations prepared by Gaetz

Architects dated August 31, 2009 on

file with the City Clerk.

• The Site Plan, survey, parking,

and landscape plan together with

the Design Development Plan and

elevations are the Final Development

Plan.

SECTION 3. The zoning map of

the City of Falcon Heights referred

to and described in Chapter 113

shall not be republished to show the

aforesaid rezoning, but the zoning

map on file in the City Clerk’s office

shall be appropriately marked for the

purpose of indicating the rezoning

provided for in this ordinance.

SECTION 4. Effective Date.

This ordinance shall be effective

immediately following Metropolitan

Council authorization to amend

the City’s Comprehensive plan

to reguide the property to multifamily

residential and passage and

publication of this ordinance.

THE CITY COUNCIL OF FALCON

HEIGHTS ORDAINS:

SECTION 1 Section 113-211 of the

Falcon Heights City Code is added

as follows.

113-211 – Amber Union

Planned Unit Development

(a) Legal Description. The legal

description of this PUD is the North

Half of the Northeast Quarter of the

Northeast Quarter of the Northeast

Quarter, in Section 21, Township

29, Range 23, Ramsey County,

Minnesota, except that part taken for

Snelling and Larpenteur Avenues.

(b) Purpose. The purpose of

the Amber Union Planned Unit

Development is to provide for

the mixed uses of multi-family

apartments and a retail space.

(c) Permitted Uses and Zoning

Regulations. The R5-M mixed use

high density residential district

regulations shall apply to the

Property subject to the following

modifications:

(1) Permitted uses: One principal

structure consisting of 111,640

square feet and 67 apartment units

and one principal structure consisting

of 59,195 square feet, 39 apartment

units, and one retail space.

(2) No conditional uses

(3) No interim uses

307.020 Composition. The

Economic Development Commission

shall consist of seven (7) nine (9) to

eleven (11) thirteen (13) members

appointed by the City Council, of

which the majority must be residents.

Membership shall be open to any

resident or non-resident business

owner representative of a Shoreviewbased

business that is interested in

the business climate and economic

development direction of the City.

Any member of the commission may

be removed by a majority vote of City
