A. WHEREAS, since 1989,

Ramsey County, Minnesota (the

“County”), has issued bonds to

finance capital improvements

identified in a capital improvement

plan developed with citizen

participation; and

B. WHEREAS, the Home Rule

Charter of the County (the “Home

Rule Charter”) is a desirable source

of authority for the issuance of such

bonds; and

C. WHEREAS, the County’s

adopted capital improvement budget

for 2019 contemplates undertaking

capital improvements financed

in part by bonds, notes or other

obligations, in one or more series, in

an estimated aggregate amount of $

10,600,000;

NOW, THEREFORE, THE BOARD

OF COMMISSIONERS OF THE

COUNTY OF RAMSEY DOES

ORDAIN as follows:

1. Authorization of Bonds - The

bonding and borrowing of money by

the issuance of general obligation

bonds, notes or other obligations, in

one or more series from time to time

as needed, in an aggregate principal

amount not to exceed $10,600,000

plus the amount of any premium paid

with respect thereto (the “Bonds”)

is hereby authorized to finance (1)

the costs of improvements set forth

in the 2019 capital improvement

budget of the County, (2) the costs

of any other improvements set forth

in the County’s capital improvement

budgets of any year and any other

capital expenditures authorized by

the County, to the extent proceeds

of the Bonds are not expended on

improvements set forth in the 2019

capital improvement budget due to

changes occurring after the date

hereof. The amount authorized

under this Ordinance is in addition to

amounts previously authorized under

prior ordinances of the County.

2. Bonding Procedure and

Terms - The Bonds shall be

scheduled for sale and awarded for

sale by resolutions. The specific

amount, maturities, interest rates

and other terms and conditions of the

Bonds and covenants with respect to

the Bonds shall be set or made by

resolution.

3. Taxes - The Bonds shall

be general obligations to which

the full faith and credit and taxing

powers of the County are pledged.

The Bonds may also be paid from

interest earnings on the debt service

account, and from any other moneys

appropriated by the County Board.

The taxes levied for the payment of

the Bonds shall not limit or reduce

the ability of the County to levy taxes

for the payment of the costs of other

capital improvements or obligations

issued to finance the payment of

such costs

4. Authorization of Refunding

Bonds - The bonding or borrowing of

money by the issuance of bonds or

other obligations to refund the Bonds

is hereby authorized on the same

basis as set forth in paragraphs 4

and 5 of Ordinance No. 93-292,

authorizing the refunding of bonds

issued prior to November 6, 1992.

Further proceedings to schedule

such refunding bonds for sale, to set

the terms and conditions thereof, to

make covenants with respect thereto

and to award the sale thereof may

be, and are hereby authorized to be,

done or taken by resolution.

5. Referendum Upon Petition

- This ordinance is subject to the

ordinance procedure of the County’s

Home Rule Charter, including the

holding of a referendum if a sufficient

petition is filed within forty-five (45)

days after its publication. Among

other conditions to be met, a

sufficient petition must be signed by

registered voters of the County equal

in number to ten percent (10%) of

those who voted in the County for

the office of President of the United

States in the last general election.

AN INTERIM ORDINANCE

MORATORIUM ON TOBACCO

STORES.

THE CITY OF OAKDALE DOES

ORDAIN:

SECTION 1. Background.

1.01. Authority. The City of

Oakdale has the authority to

establish moratoriums to regulate,

restrict or prohibit any use or

development of certain uses in all

or part of the City. In particular,

pursuant to Minnesota Statutes

Section 462.355, Subd. 4, the City

is authorized to adopt a planning

moratorium on uses while the City or

its planning consultant is conducting

studies, or has authorized a study

to be conducted, or has scheduled

a hearing to consider adoption or

amendment of the comprehensive

plan or official zoning controls.

1.02. Findings and Purpose. The

City of Oakdale currently licenses

tobacco stores and regulates them

through zoning controls. There are

currently three tobacco stores located

in the City and staff has recently

received inquiries from others about

opening up tobacco stores in the

City. There are substantial concerns

that the City’s current licensing and

zoning provisions relating to tobacco

stores do not adequately address

issues relating to tobacco stores,

such as appropriate locations,

conditions under which they may be

allowed, compatibility with existing

uses, and potential limitations on

the total number of stores allowed.

There are also concerns about

recently developed nicotine-delivery

technology, such as e-cigarettes

(vaping), and how access to said

technology might affect the health,

safety, and welfare of the City’s

residents, including its youth. As a

result of the these important licensing,

land use, and zoning issues, the City

desires to conduct studies for the

purpose of consideration of possible

amendments to the City’s licensing

provisions and official controls to

address the issues concerning

tobacco stores. The City finds that

this Interim Ordinance is necessary

to protect the planning process and

the health, safety and welfare of its

residents.

SECTION 2. Definition. For

purposes of this Interim Ordinance,

the term “tobacco store” means any

retail establishment that derives at

least 90% of its revenue from the

sale of tobacco, tobacco products,

tobacco-related devices, and nicotine

or lobelia delivery devices, as those

terms are defined in Oakdale City

Code, section 9-30.

SECTION 3. Prohibition.

3.01. In accordance with

the findings set forth in Section 1.02,

a licensing and zoning moratorium is

established on tobacco stores within

the City.

3.02. During the effective period of

this Interim Ordinance, applications

for a business license, building

permit, or zoning approval for a

tobacco store will not be processed

or approved and no application for

such approvals shall be accepted by

the City. This Interim Ordinance also

prohibits the further consideration

and approval of any pending license

or zoning applications for a tobacco

store.

SECTION 4. Enforcement.

The City may enforce this Interim

Ordinance by injunction or any other

appropriate civil remedy in any court

of competent jurisdiction.

SECTION 5. Separability. Every

section, provision or part of this

Interim Ordinance is declared

separable from every other section,

provision or part. If any section,

provision or part of this Interim

Ordinance is adjudged to be invalid

by a court of competent jurisdiction,

such judgment shall not invalidate

any other section, provision or part.

SECTION 6. Duration. This

Interim Ordinance shall take effect

immediately upon its adoption and

publication and shall remain in effect

until the date of the adoption of any

new licensing provisions and official

controls pertaining to tobacco stores

or until February 11, 2020, whichever

occurs first.

This Interim Ordinance shall take

effect and be in full force from and

after its adoption and publication, as

provided by law.

until 1:00 pm, CDT, Friday, March 1,

2019, and then opened publicly.

The Work consists of furnishing

all labor, materials, equipment,

skills, and performing all operations

required to construct the Work. The

Work includes, but is not limited to,

mobilization and demobilization;

furnishing, installing, maintaining,

and removing erosion control

facilities; herbaceous vegetation

and invasive species removal;

disposal and rough-bank grading;

coir-log installation, preparing

soil, transporting and installing of

all seeds, live plants and other

materials required for: (1) shoreline

and soil stabilization practices, (2)

seeding and planting of native plant

species, (3) the establishment and

protection of seeded areas and live

plants, (4) site-wide management for

all invasive species for two growing

seasons post-contract period;

all as provided for in the Bidding

Documents. All quantities and work

items in this advertisement for bid are

approximate and are not guaranteed.

representatives of the City of Lake

PM CST, on Thursday, March 21,

2019. Bids are for furnishing all work

and materials for the construction,

complete in place, of the 2019 Mill

and Overlay Project for the City of

Specifications will not be taken by

the City.

Bids will only be accepted from

Contractors who purchase Bidding

Documents as specified above.

No bid will be considered unless

sealed and filed with the City Clerk

prior to the time noted above for the

closing of the bids, and accompanied

by a certified check, cash, or bid

bond in an amount not less than

five percent (5%) of the total bid

as a guarantee that the bidder, if

successful, will enter into a contract

with the City to perform the work

described in the proposal. This

deposit will be subject to forfeiture

as provided by law. The deposits

for the three lowest bidders will be

retained by the City until the contract

has been awarded and executed but

not longer than sixty (60) days. No

bid may be withdrawn for a period

of sixty (60) days following the bid

opening.

The City reserves the right to reject

any or all bids, to waive informalities

or to award the contract to the

lowest responsible bidder, in the

best interest of the City. For Bids

exceeding $50,000, the Bidder shall

submit to the City a signed statement

under oath by an owner or officer

verifying compliance with each of

the minimum criteria in Minnesota

Statutes, section 16C.285,

subdivision 3 on the Responsible

Contractor Verification Form included

Maplewood City Council will meet

in the Council Chambers of City

Hall to consider the making of the

improvement hereinafter described:

Proposed City Project No. 18-01

Ferndale-Ivy Area Street

Improvements

The general nature of the proposed

improvements includes the full

reconstruction of the project streets.

This includes the removal and

replacement of the concrete curb

and gutter, the installation of a sand

sub-base and aggregate base,

and the installation of new asphalt

pavement. This project will also

include the installation of sidewalks

on select project streets, repairs to

the watermain and sanitary sewer

systems, upgrades and expansion

of the storm sewer system, and

restoration of boulevard areas.

The properties in the general area

proposed to be assessed for the

improvement are as follows:

cul-de-sac to Century Avenue

(T.H. 120), Ferndale Street from

Maryland Avenue to Ivy Avenue,

Dennis Street from Ivy Avenue to

Hawthorne Avenue, Farrell Street

from Ivy Avenue to Hawthorne

Avenue, Hawthorne Avenue from

Farrell Street to Dennis Street,

Mayhill Road from Ivy Avenue to

cul-de-sac.

THE TOTAL ESTIMATED COST OF

SAID IMPROVEMENT PROJECT IS

$3,806,000.

Pursuant to Minn. Stat. 429.011 to

429.111, it is proposed to assess

every lot, piece or parcel of land

benefited by said improvement

whether abutting thereon or not,

based upon benefits received

without regard to cash valuation.

A reasonable estimate of the impact

of the assessment will be available

at the hearing. Persons desiring

to be heard by the Maplewood City

Council in reference to the proposed

improvement should be present at

this hearing.
