AN ORDINANCE PROVIDING FOR THE VACATION OF A RIGHT-OF-WAY 

BY ORDINANCE PURSUANT TO CITY CODE 

The City Council of South St. Paul does ordain: 

SECTION 1. Pursuant to Minn. Stat. § 412.851 and South St. Paul City Code Section 54-428, on its own motion, with a vote of four of its members, the City Council may vacate any street, alley or public right-of-way within the City by Ordinance. 

WHEREAS, 5th Street South was dedicated to the City on the plats of Riverside Addition to the City of St. Paul and Tarbox Addition to South St. Paul; and 

WHEREAS, pursuant to that Resolution adopted by the City Council of the City of South St. Paul, on June 5th, 1978, subsequently recorded as Document No. 517928 on August 2nd, 1978, with the Office of the County Recorder in Dakota County, the following portion of 5th Street was vacated: 

The North 27.5 feet and the South 27.5 feet of that part of 5th Street South lying between the West line of Concord Street and a line described as: 

Commencing at the Northwest corner of Lot 1, Block 10, Tarbox Addition, thence Northerly to a point on the South line of Lot 20, Block 20, Riverside Park Addition 190 feet West of the Southeast Corner of said Lot 20; and 

WHEREAS, such vacation left a gap of approximately five feet of unvacated right-of-way lying in between said vacated portions of 5th Street South; and 

WHEREAS, pursuant to Minnesota Statutes § 412.851 and § 462.358, subd. 7 and City Code Section 54-428, the City of South St. Paul held a public hearing on the proposed vacation of such portion of unvacated 5th Street legally described as follows: 

Any remaining unvacated portion of 5th Street South dedicated on the plats of Riverside Park Addition to the City of St. Paul and Tarbox Addition to South St. Paul lying between the West line of Concord Street and a line described as: 

Commencing at the Northwest corner of Lot 1, Block 10, Tarbox Addition, thence Northerly to a point on the South line of Lot 20, Block 20, Riverside Park Addition 190 feet West of the Southeast Corner of said Lot 20. 

WHEREAS, notice of a public hearing on said vacation was duly published, posted and mailed in accordance with applicable Minnesota Statutes and a public hearing was held on the 4th day of December, 2017, at the City of South St. Paul City Hall, 123 - 3rd Avenue North, South St. Paul, Minnesota, 55075; and 

WHEREAS, the City Council of South St. Paul then proceeded to hear all persons interested in said vacation and all persons interested were afforded an opportunity to present their views and objections to said vacation; and 

WHEREAS, the City Council of South St. Paul has determined that the vacation would be in the public interest. 

NOW THEREFORE THE CITY OF SOUTH ST. PAUL DOES ORDAIN: 

1.That pursuant to Minnesota Statutes § 412.851 and § 462.358, subd. 7 and City Code Section 54-428, the City of South St. Paul hereby vacates the right of way situated in the City of South St. Paul, County of Dakota, State of Minnesota and dedicated on the plats of Riverside Park Addition to the City of St. Paul and Tarbox Addition to South St. Paul legally described as: 

Any remaining portion of unvacated 5th Street South lying between the West line of Concord Street and a line described as: 

Commencing at the Northwest corner of Lot 1, Block 10, Tarbox Addition, thence Northerly to a point on the South line of Lot 20, Block 20, Riverside Park Addition 190 feet West of the Southeast Corner of said Lot 20. 

2.That said vacation has no relationship to the City’s Comprehensive Plan and therefore the South St. Paul City Council has dispensed with the requirements of Minn. Stat. § 462.356, subd. 2, that may require the South St. Paul Planning Commission to perform a Comprehensive Plan compliance review of said vacation that may constitute a disposal of real property pursuant to § 462.356, subd. 2. 

SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage and publication according to law.

AN ORDINANCE AMENDING SECTION 153.004, 153.051, 153.111, 153.126, 153.040 AND 153.235 OF THE WEST ST. PAUL CITY ZONING CODE REGARDING SMALL WIRELESS FACILITIES 

SUMMARY PUBLICATION. Pursuant to Minnesota Statutes Section 412.191, in the case of a lengthy ordinance, a summary may be published. While a copy of the entire ordinance is available without cost at the office of the City Clerk, the following summary is approved by the City Council and shall be published in lieu of publishing the entire ordinance: 

The ordinance amends the City’s right-of-way ordinance to provide for small cell facilities within the City’s right-of-way. Anyone wishing to erect or install a small cell wireless facility will be required to apply for a permit. There are certain statutory provisions regarding requirements and the timing of the City’s approvals, however, the City can require some additional conditions to protect the public health, safety and welfare.
